Pathway To Permanent Residence For TSS Visa Holders

In March 2022 legislative amendments were introduced to provide a pathway to permanent residence through the sc186 Temporary Residence Transition stream for holders of a sc482 TSS visa in the short-term stream who were in Australia for at least 12 months between 1 February 2020 and 14 December 2021.


However, since the initial announcement it has been clarified that this pathway will only be available until 30 June 2024. As eligibility for a sc186 visa under the TRT stream requires the applicant to have been working in the nominated position for at least 3 years, applicants will only be able to meet eligibility requirements if they already hold a sc482 TSS visa. Applicants granted their sc482 TSS visa on or after 1 July 2021 will not be able to meet the eligibility criteria by 30 June 2024.


Concessions have been introduced to allow for certain sc482 TSS visa holders to apply for a third short-term stream TSS visa before 1 July 2023 which would enable them to access the pathway to permanent residence. In addition an age concession has been introduced for legacy 457 workers aged over 45 who were in Australia for at least 12 months between 1 February 2020 and 14 December 2021.
